The Italian law dispositions as to the exercise and to the maintenance of thermo systems, with particular attention through combustion controls and sanctions for the Norma inobservance, are defined in the Italian law 10/91 DPR 412/93 – UNI 10389 and renovated with DPR 551 Official Gazette 06/04/2000 and nowadays at Europe level is studying and approving new dispositions and modifications.

Some articles (ART.11 Exercise and maintenance of the thermo systems and relative controls) have specified that the maintenance of the thermo systems are under office owner responsibility or under a third party responsibility nominated by the owner.

Thermo system maintenance is compulsory, therefore has to be followed in the right way following the prescriptions of the in force normative UNI 10389

UNI 10389 specifies in the comma 1 that this Norma has applied to all heat generators with the furnace thermo power equal or higher than 4 KW powered by gaseous and/or liquid combustion, planed into system for room’s heating. In the Norma there is a well specific point (comma 5.5) that talks about the analysis of flue gas combustion. The following modification into DPR 551 provides in the comma 11 that " The instructions for the book filling has to be effectuated during the first service after having analysed combustion parameters from the installator firm…. that must give a declaration of conformity”.

Italian art. 31 of comma 3 provides that city offices with more than 40.000 inhabitants carry out necessary controls, and check the application of the normative almost every 2 years. The checking procedure and control provides that at the end of the operation will give an H model certificate (auto certification) called “bollino blu”.

With the DPR 551 changes, spot verifications have to be done on 5 % of installations. In few time every Italian regions will be adapted to this law, therefore every owner or joint-ownership administrator, or the eventual installator that has the responsibility of the system, that is not in compliance with the art. 31 commas 1 and 2, is punished with an administration sanction, further to answer of eventually damages caused from the boiler.
